theEMPLOYEEapp® Privacy Policy

At theEMPLOYEEapp by APPrise Mobile (“theEMPLOYEEapp”), we take the privacy of our customers as one of our most important and serious priorities. Your privacy and that of your employees is important to you and to us. As a customer of theEMPLOYEEapp, it is our commitment that we will protect the information you share with us both before you become a customer and once you are a customer.

To protect your privacy, theEMPLOYEEapp follows different principles in accordance with worldwide practices for customer privacy and data protection. This privacy policy (the “Privacy Policy”) has been compiled to better serve those who are concerned with how their personally identifiable or corporate information is being used either on its own or with other information. Please read our Privacy Policy carefully to understand how we collect, use, protect or otherwise handle your information with respect to the services provided by theEMPLOYEEapp (“Services”). In conjunction with this Privacy Policy we recommend that you also review theEMPLOYEEapp’s Terms of Service that can be found at http://www.theemployeeapp.com/terms-of-service (the “Terms of Service”). As a customer of theEMPLOYEEapp (“Customer”) or an employee or other individual invited by a customer to download that customer’s app (“End User”), the Customer has agreed to the Terms of Service prior to becoming a customer or providing you with access to their app.

This Privacy Policy became effective on January 1, 2015. If it changes, the revised policy will include a new effective date and will be posted on this page. As a customer of theEMPLOYEEapp, if we make any material changes to the Privacy Policy we will notify you by email which will be sent to the primary email account provided when you registered to become a customer. We therefore encourage you to check the Privacy Policy whenever you submit new or updated personal data or when you post new content or database information to theEMPLOYEEapp. Your continued use of the Services provided by theEMPLOYEEapp following the posting of any amendment will constitute your acceptance of any changes to the Privacy Policy.

We categorize information we collect into three categories: (i) Account Holder Information, (ii) Customer Content and Database Information, (iii) End User Information.

Account Holder Information

As a customer of theEMPLOYEEapp, you are required to provide information about yourself, the organization you work for as well as billing and credit card information (the “Account Holder Information”). The Account Holder Information may include the following information: First name, last name, company/organization name, phone number, mailing address, email address, credit card information, and password. You may review and update the Account Holder Information by logging into the content management system (“CMS”) provided to you as part of the Services and editing such information by clicking on the General Information button. If you remove any of the required Account Holder Information, we reserve the right to cancel your account.

We will use the Account Holder Information to process your employee app (“App”). We will never give or sell it to any person or entity except as provided in this Privacy Policy.

We may use the Account Holder Information in the following ways:

  • To allow us to provide better customer support and to respond quicker to your customer service requests
  • To quickly process account and billing transactions to ensure that your employee app service goes uninterrupted
  • To provide to third parties that we use to provide the Services including, for example, web hosting providers, email vendors, payment processors, analytics providers, maintenance service providers, database management and other consultants who work on our behalf and under contractual promises of confidentiality. In retaining the services of these third parties, such retention is based on our instructions and in compliance with this Privacy Policy.
  • To send periodic emails to you regarding your App, new products and services as well as upgrades and enhancements to theEMPLOYEEapp platform.
  • To investigate and prevent fraudulent transactions, unauthorized access to the Services and other illegal activities
  • We may share the Account Holder Information in connection with or during negotiations of any merger, sale of our company’s assets, financing or acquisition of all or a portion of our business to another company
  • We may share the Account Holder Information with the company or organization on whose behalf you are creating an App.

Customer Content and Database Information

As a customer of theEMPLOYEEapp, you or others who you authorize, will upload important and sometimes proprietary or confidential content/information (“Content”) to the CMS we provide you as part Customer Content and Database Information of the Services. In addition, you will be adding employees or other individuals into the CMS either manually or by uploading a database of individuals (collectively referred to as the “Database of Users”). In doing so, you will be including a unique identifier (e.g. email address or some form of employee identification number) for each individual in the Database of Users (the “Unique Identifier”). The Content, Database of Users and Unique Identifier are sometimes referred together as the “Services Information.”

theEMPLOYEEapp offers sharing functionality that allows the Content to be shared via email and social networks including Facebook, Twitter and LinkedIn. In uploading Content to the CMS, you have the ability to disable the sharing functionality. For further information on enabling or disabling sharing of the Content, you should review the instructions contained within the CMS or contact theEMPLOYEEapp Customer Care department.

theEMPLOYEEapp will never give, share or sell the Services Information to any person or entity except as provided in this Privacy Policy. We may, however, use the Services Information for the following purposes including:

  • Providing and enabling the use of theEMPLOYEEapp Services
  • Understanding and improving our product and offering
  • Investigating and preventing our products and offering from being subject to fraud and abuse
  • Ensuring compliance with the Terms of Service
  • Complying with any legal process, regulations, laws or government requests
  • Protecting theEMPLOYEEapp, its customer and the public from harm or illegal activity or to respond to an emergency that we believe requires us to provide the Services Information so as to avoid someone’s death or serious injury
  • If we raise funds or engage in merger, acquisition or proceeding that involves transfer of information
  • We may share the Services Information in connection with or during negotiations of any merger, sale of our company’s assets, financing or acquisition of all or a portion of our business to another company
  • For other purposes about which we notify you.

For purposes of our marketing activities, theEMPLOYEEapp may analyze your use and the use by those individuals contained in the Database of Users of (i) the CMS, (ii) the App and (iii) theEMPLOYEEapp Services. This may include but is not limited to analysis of how the individuals in the Database of Users utilize the App, the Content they view, time spent on the Content and their use of different App features. We may also obtain information from third parties, including Google Analytics, and combine that with information we collect. theEMPLOYEEapp may then share such analysis in a manner that is aggregated and non-identifiable to a particular Customer or individual in the Database of Users. As per the Terms of Service, we also have the right to solicit feedback from the individuals contained in the Database of Users. In becoming a customer of theEMPLOYEEapp or as an individual contained in the Database of Users, you consent to us sharing the Services Information in a manner that is aggregated and non- identifiable. You also agree to us soliciting feedback and sharing such feedback in a manner that is aggregated and non-identifiable. In addition, as per the Terms of Service, you agree not to upload Protected Health Information (“PHI”) as defined under the Health Insurance Portability and Accountability of 1996 Act as amended (“HIPAA”) and theEMPLOYEEapp disclaims all liability for such PHI.

With respect to the CMS, we use technologies like cookies to provide, improve and protect the Services. The cookies we use are session-based which means that the cookies only last while your browser is open and are automatically deleted when you close your browser. The purpose for the session-based cookies is that they allow us to remember that you are logged into your CMS through a browser or are logged into the App. When you access your CMS through a web browser, you can manage your cookies settings. If all cookies are disabled, you will not be able to use the CMS. This paragraph regarding cookies does not apply to the End User’s use of theEMPLOYEEapp.

theEMPLOYEEapp takes reasonable measures to protect the Services Information provided to us from loss, misuse and unauthorized access or disclosure. When you upload the Services Information, we encrypt the transmission of that information between the computer upon which the Customer accesses the CMS and theEMPLOYEEapp servers using secure socket layer technology (SSL). In addition, with regard to the Content, the Content remains encrypted on theEMPLOYEEapp’s servers. However, when the Content is opened on an End User’s mobile device, it is no longer encrypted on that device. theEMPLOYEEapp follows generally accepted standards to protect the personal data submitted to us, both during transmission and once we receive it. Customer Content and Database Information

In order to download and log-in to theEMPLOYEEapp, individuals contained in the Database of Users will have to register. In doing so, they will be required to provide the following information: an email address; a password they create; their first and last name; and the Unique Identifier (collectively referred to as the “End User Information”).

theEMPLOYEEapp will never give, share or sell the End User Information to any person or entity except as provided in this Privacy Policy. We may, however, use the End User Information for the following purposes including:

  • Providing and enabling the use of theEMPLOYEEapp Services
  • Understanding and improving our product and offering
  • Investigating and preventing our products and offering from being subject to fraud and abuse
  • Ensuring compliance with the Terms of Service
  • Complying with any legal process, regulations, laws or government requests
  • Protecting theEMPLOYEEapp, its customer and the public from harm or illegal activity or to respond to an emergency that we believe requires us to provide the End User Information so as to avoid someone’s death or serious injury.
  • Where third parties that theEMPLOYEEapp works with on behalf of theEMPLOYEEapp requires access to your information to carry out their work (e.g. customer support, billing, etc.)
  • If we raise funds or engage in merger, acquisition or proceeding that involves transfer of information
  • We may share the End User Information with the company or organization who the End User works for and/or who has made the App available to the End User
  • For other purposes about which we notify you.
